PARTICIPANT AGREEMENT FOR MARINE MILLS FOLK SCHOOL
In return for being allowed to participate in Marine Mills Folk School (“MMFS”) activities, including any activities incidental to such participation (“Participant Activities”), the undersigned Participant (“I”, “me”, or “my”) releases and agrees not to sue MMFS or its officers, directors, lessors, landlords and their Lessee’s including the City of Marine on St. Croix and its agencies, employees, sub-contractors, sponsors, successors and assigns (collectively “MMFS”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, sickness, personal injury, or wrongful death arising as a result of my participation in the Participant Activities wherever, whenever, or however the same may occur to the extent set forth herein under “Waiver of Liability” and “A.)Negligence Claims”.
I hereby freely and voluntarily, without duress, execute this Waiver under the following terms:
Waiver of Liability. I, the Participant, hereby voluntarily and forever release and discharge MMFS from, covenant and agree not to sue MMFS for, and waive, any claims, demands, actions, causes of action, debts, damages, losses, costs, fees, expenses or any other alleged liabilities or obligations of any kind or nature, whether known or unknown (collectively, “Negligence Claims”) for any injuries to me in the use of MMFS’ premises and services which arise out of, result from, or are caused by any negligence of MMFS or me.
Negligence Claims. I understand that Negligence Claims include but are not limited to MMFS’s: (1) negligent design, construction (including renovation or alteration), repair, maintenance, operation, supervision, monitoring, or provision of MMFS premises and services; (2) negligent failure to warn of or remove a hazardous, unsafe, dangerous or defective condition; (3) negligent failure to provide or keep premises in a reasonably safe condition; (4) negligent provision or failure to provide emergency care; (5) negligent provision of services; and (6) negligent hiring, selection, training, instruction, certification, supervision or retention of employees, independent contractors or volunteers; or (7) other negligent act(s) or omission(s).
Insurance. I, the Participant, understand that I expressly waive any such claim for compensation or liability on the part of MMFS beyond what may be offered freely by the representative of MMFS in the event of such injury or medical expense. I also acknowledge that MMFS has not arranged and does not carry any insurance of any kind for my benefit or that of Participant (if Participant is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors and assigns. I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should limit or prevent my participation in Participant Activities.
Other. I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota in the United States of America, and that this Waiver shall be governed by and interpreted in accordance with the laws of this State. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. I also understand that this document is a contract which grants certain rights to and eliminates certain liability of MMFS.
